EULA – End User License Agreement (App Store)
Version: 2025. This is a courtesy translation. The German version is legally binding.
1. Contracting parties
This End User License Agreement ("EULA") is concluded between:
Morus Media GmbH Oberstraße 3 47829 Krefeld HRB 21221 Managing director: Tom Walter (hereinafter "Ombrie")
and the user ("you" or "user").
Apple is not a party to this EULA.
2. Grant of license
Ombrie grants the user a non-exclusive, non-transferable, revocable license to install the Ombrie app exclusively on devices and to use it within the scope of this EULA.
Reverse engineering, copying or modifying the app is prohibited.
3. Use of the app
The app may only be used by registered clippers. The purpose of the app is to:
- view tasks
- access guidelines
- create content
- track payouts
There is no entitlement to available tasks or income.
4. Content & grant of rights
All content created by the user (videos, clips, etc.) is subject to the following provisions: users grant Ombrie unrestricted, worldwide, transferable and sublicensable rights of use. The grant of rights takes effect upon registration. Rights remain in place even after uninstalling the app.
Brands in turn grant Ombrie and all clippers unrestricted rights of use to their raw footage.
5. Remuneration
Remuneration is variable based on performance (e.g. views). An entitlement to payout only arises if all rules have been met, no manipulation has occurred and videos remain public.
Ombrie may refuse payouts if misuse is suspected.
6. Prohibited uses
The following are prohibited in particular:
- buying views/engagement
- using the app for illegal purposes
- circumventing systems or rules
- creating multiple accounts
- interfering with app functionality
7. Limitation of liability
Ombrie is only liable for intent or gross negligence. There is no liability for suspensions by TikTok, missing tasks, technical failures, data loss or lost income.
8. Data protection
Data processing is governed by the privacy policy of Morus Media GmbH.
9. Termination
The user may terminate the license at any time by deleting the app. Ombrie may revoke the license at any time.
10. Apple-specific clauses
Apple is not a party to this EULA. Apple is not responsible for maintenance, support or damages of the app. Apple is entitled to enforce this EULA against the user.
Claims regarding product defects can be reported directly to Apple; Apple may refund at its own discretion. The app must be used in accordance with applicable App Store guidelines.
11. Applicable law
German law applies exclusively. Place of jurisdiction is Krefeld.
